Vehicles

Ask the registering authority whether your vehicle gift needs an affidavit. An affidavit is a written statement made under oath. You can make one at any police station. Seller and buyer transfer paperwork is separate. After ownership changes, register and license the vehicle within 21 days after a change of ownership. How to use it

  1. Ask before preparing a statement Before preparing an affidavit for a gift, ask the registering authority whether it requires one. You can make an affidavit at any police station. An officer provides a standard form and helps you complete the process.
  2. Read the statement before swearing An affidavit is a written statement made under oath. Read the full statement before you swear that the contents are true. You may be prosecuted if any part of the statement is false. If a detail is wrong, ask the officer for help before swearing to it.

Document checklist

  1. Registration certificate Ask the seller to hand over the vehicle registration certificate. Keep it with the transfer papers you take to the registering authority.
  2. Buyer’s transfer papers Ask whether these buyer papers apply to your gift. If requested, have the registration form obtained from the seller and a roadworthiness certificate ready. The buyer is responsible for ensuring that the vehicle is roadworthy.
  3. Proof of title If the registering authority asks for proof of your right to be registered as title holder, prepare an invoice or a sales agreement.
  4. Address proof If proof of residential address is required and the utility bill is not in your name, the owner of the bill must make an affidavit declaring that you live at the address. The utility bill must be attached to the affidavit.
  5. Western Cape pre-owned vehicle papers For a pre-owned vehicle registration in the Western Cape, check that you have: proof of purchase/acquisition of the vehicle. A roadworthy certificate is needed if the current certificate is older than 60 days. Check that the vehicle licence is current: ensure that the licence of the vehicle is up to date.
